The Supreme Court Nominating Commission has nominated attorneys Maria Teresa "Terry" Fox, Blain David Myhre and Patrick T. O'Rourke for a vacancy on the Colorado Court of Appeals, officials said Wednesday.
Whoever is selected will succeed Colorado Court of Appeals Judge Sean Connelly, who has decided not to stand for retention. His term expires in January 2011.
Karen Steinhauser, an attorney with Isaacson Rosenbaum in Denver who also is an adjunct professor at the University of Denver, said the "CSI effect" is a double-edged sword in prosecutions.
"On one hand, the scientific evidence that we see now is different than we had 15 years ago and can assist the jurors hopefully more," Steinhauser said. "On other hand, what the CSI effect has done, is it has said to jurors that in basically every crime scene you'll have physical evidence and DNA and all this stuff on TV they can do. In very many criminal cases, you still don't have that type of evidence."
